GeekAca Inc. (the "Company") sets out this privacy policy (this "Policy") regarding the handling of users' personal information in the services provided on this website (the "Services").
Article 1 (Personal Information)
"Personal information" means personal information as defined in the Act on the Protection of Personal Information (the "APPI"): information about a living individual that can identify a specific individual by name, date of birth, address, telephone number, contact details or other descriptions, as well as information that can identify a specific individual on its own, such as data on appearance, fingerprints or voiceprints and the insurer number on a health insurance card ("personal identification information").
Article 2 (How Personal Information Is Collected)
When a user registers for the services, the Company may ask for personal information such as name, date of birth, address, telephone number, email address, bank account number, credit card number and driver's license number. The Company may also collect information that includes personal information, such as records of transactions and payment information between the user and the Company's partners (including information providers, advertisers and advertising distributors; the "Partners"), from those Partners.
Article 3 (Purposes of Collecting and Using Personal Information)
The Company collects and uses personal information for the following purposes.
- To provide and operate the Company's services
- To respond to inquiries from users (including verifying their identity)
- To send users, by email or other means, information on new features, updates and campaigns for the services they use, and on other services the Company provides
- To contact users as necessary, such as for maintenance and important notices
- To identify users who violate the terms of use or attempt to use the services for fraudulent or improper purposes, and to refuse their use
- To allow users to view, change and delete their registered information and check their usage
- To bill users for paid services
- Purposes incidental to the above
Article 4 (Changes to the Purpose of Use)
- The Company will change the purpose of use of personal information only where the new purpose is reasonably deemed to be related to the previous one.
- When the purpose of use is changed, the Company will notify users of the new purpose by the method it prescribes, or publish it on this website.
Article 5 (Provision of Personal Information to Third Parties)
The Company will not provide personal information to third parties without the user's prior consent, except in the following cases and where otherwise permitted by the APPI or other laws.
- Where it is necessary to protect a person's life, body or property and it is difficult to obtain the individual's consent
- Where it is especially necessary to improve public health or promote the sound development of children and it is difficult to obtain the individual's consent
- Where it is necessary to cooperate with a national agency, a local government or a party entrusted by either of them in carrying out affairs prescribed by law, and obtaining the individual's consent is likely to impede those affairs
- Where the Company has notified or published the following matters in advance and filed a notification with the Personal Information Protection Commission
- That the purpose of use includes provision to third parties
- The items of data to be provided to third parties
- The means or method of provision to third parties
- That provision of personal information to third parties will be stopped at the individual's request
- How the individual's request is accepted
Article 6 (Disclosure of Personal Information)
- When an individual requests disclosure of their personal information, the Company will disclose it without delay. However, the Company may withhold all or part of it where disclosure would fall under any of the following, and will notify the individual without delay if it decides not to disclose. A fee of 1,000 yen per request is charged for disclosure.
- Where it is likely to harm the life, body, property or other rights or interests of the individual or a third party
- Where it is likely to seriously impede the proper conduct of the Company's business
- Where it would otherwise violate laws or regulations
- Notwithstanding the preceding paragraph, information other than personal information, such as history and characteristic information, will not be disclosed as a rule.
Article 7 (Correction and Deletion of Personal Information)
- Where the personal information the Company holds about a user is incorrect, the user may request that the Company correct, add to or delete it (a "Correction") in accordance with the procedure the Company prescribes.
- Where the Company receives such a request and determines that it needs to be granted, it will make the Correction without delay.
- The Company will notify the user without delay when it has made a Correction under the preceding paragraph or decided not to.
Article 8 (Suspension of Use of Personal Information)
- Where an individual requests that the use of their personal information be suspended or that it be erased (a "Suspension") on the grounds that it is being handled beyond the scope of the purpose of use or was obtained by improper means, the Company will conduct the necessary investigation without delay.
- Where, based on the results of that investigation, the Company determines that the request needs to be granted, it will carry out the Suspension without delay.
- The Company will notify the user without delay when it has carried out a Suspension under the preceding paragraph or decided not to.
- Notwithstanding the preceding two paragraphs, where a Suspension would require a large expense or is otherwise difficult, and alternative measures necessary to protect the user's rights and interests can be taken instead, the Company will take those alternative measures.
Article 9 (Changes to This Policy)
- The Company may change the contents of this Policy without notifying users, except for matters otherwise provided by law or in this Policy.
- Unless the Company provides otherwise, the revised privacy policy takes effect when it is posted on this website.
